Dallas, Texas, Aug. 5, 2009 — Brant C. Martin and J. Sean Lemoine, partners in the law firm of Wick Phillips, won a decisive victory on behalf of client Timothy Looney of Texas in California state court on July 24, 2009.

After a five week trial, a twelve person jury found in favor of Mr. Looney on his breach of contract claim against Irvine Sensors Corporation. The jury also found against the counterclaims brought against Looney by the defendant that alleged fraud, negligent misrepresentations, and breach of contract – resulting in a win for him on all counts.

The lawsuit stemmed from the 2005 acquisition of Optex Systems, Inc., a Richardson, Texas company, by Irvine Sensors Corporation [IRSN], based in Costa Mesa, California. Mr. Looney filed suit in January 2008, alleging that Irvine had breached its obligations under a Registration Rights Agreement. Irvine counterclaimed in June 2008, alleging fraud, negligent misrepresentation, and breach of contract against Mr. Looney personally, seeking recovery of over $15 Million.

After only three hours of deliberation, the jury decided unanimously on all counts in favor of Mr. Looney. Mr. Looney stated, “Observing Mr. Martin and Mr. Lemoine handle the case was like watching a pair of ace pitchers throw a perfect game as they presented the facts and retired the opposition’s case point by point over the course of the trial.”

Mr. Martin was recently named as a “40 Under 40” honoree by the Fort Worth Business Press. Mr. Martin and Mr. Lemoine were both recently named as “Rising Stars” by Texas Monthly magazine. Together they are partners in the trial section of Wick Phillips, a full service business law firm with offices in Dallas and Fort Worth, Texas.
