Wick Phillips, a full-service business law firm, announces that the U.S. Court of Appeals for the Fifth Circuit in New Orleans issued a favorable ruling in the litigation styled, BroadStar Wind Systems Group v. Thomas Stephens, et al., Case No. 11-10025.

In the case, the Defendant, former officer and owner Thomas Stephens, contended that he and not BroadStar owned certain technology related to the AeroCam™ wind turbine, an advanced wind turbine design that could have a number of practical applications for generating green energy. Following oral argument in December, the Fifth Circuit affirmed the District Court’s Declaratory Judgment, which had rejected Stephens’s arguments and confirmed that BroadStar was the rightful owner of the technology including all relevant patents.

Andrew M. Gould and Marcia N. Jackson, co-counsel for BroadStar, said the Fifth Circuit’s decision is significant and has allowed the successor entity to BroadStar to move forward with its plans to raise the additional capital necessary to shift the advanced design to the commercialization stage. “The District Court’s ruling in BroadStar’s favor was an essential first step in this dispute,” said Gould. “BroadStar is pleased the Fifth Circuit reached the same conclusion as the U.S. District Court for the Northern District of Texas.”
