Wick Phillips Gould & Martin, LLP, a full-service business law firm, has resolved an important suit brought on behalf of its client, NextPay Merchant Services, against four former employees and various business entities affiliated with the individuals. The suit alleged that the individuals formed a competing venture while working for the merchant services provider and sought to divert both merchants and confidential and proprietary information away from NextPay.

NextPay was formed in March 2009 by Mark Brinkman, President and Founder of Brinkman Financial Company, LP, a leading provider in customized financial systems over the past 26 years. The individuals resigned their employment on August 2, 2010. Suit was filed August 17, 2010 and, following accelerated discovery and numerous depositions, the parties were able to reach a satisfactory settlement in January 2011.

The case is NextPay v. Varnell, et al., Cause No. 10-10166 (298th Jud. Dist. Dallas County, Texas).
